Welcome to KateMail.
These Terms of Service ("Terms") govern your access to and use of KateMail.app and the services we provide through KateMail, including email processing, Ask Kate, reminder and tag suggestions, search, and related features (collectively, the "Service").
By creating an account or using KateMail, you agree to these Terms. If you do not agree to them, please do not use the Service.
1. What KateMail does
KateMail is a personal email organisation and information-retrieval service.
Depending on the features available to you, KateMail may allow you to:
- forward or automatically forward emails to a KateMail address;
- store and organise emails and attachments;
- use artificial intelligence to analyse email content;
- receive suggested reminders, tags and other extracted information;
- search information from emails you have provided to KateMail;
- ask questions about your stored information using Ask Kate; and
- use other email organisation and productivity features we make available.
KateMail is designed to help you organise and retrieve information. It is not intended to replace your original email service, calendar, records, backups, professional advisers, or your own review of important information.
2. Your account
You are responsible for providing accurate information and keeping your account secure.
You are also responsible for:
- activity performed through your account;
- protecting your login credentials;
- configuring email forwarding and sender settings correctly; and
- notifying us if you believe your account has been accessed without authorisation.
You must not access another person's KateMail account without permission or use the Service in a way intended to circumvent account or plan limits.
You must be at least 18 years old, or the minimum age required to enter into these Terms in your country, to create an account.
3. Your content
"User Content" means emails, attachments, documents, questions, text and other information that you submit, forward, upload or otherwise provide to KateMail.
You retain ownership of your User Content.
By using KateMail, you give us permission to receive, store, copy, analyse, transform and otherwise process your User Content only as reasonably necessary to provide, maintain, secure, support and improve the Service, as further described in our Privacy Policy.
You are responsible for ensuring that you have the right to provide User Content to KateMail.
Emails and attachments may contain information about other people. You should only forward or upload such information where you are permitted to do so.
You must not knowingly use KateMail to store, process or distribute content that:
- is unlawful;
- infringes another person's rights;
- was obtained through unauthorised access;
- contains malicious software;
- is intended for phishing, fraud, spam or abuse; or
- is intended to compromise KateMail or another system or account.
4. Artificial intelligence
KateMail uses artificial intelligence and automated systems to analyse and organise information.
AI functionality is subject to reasonable usage and abuse-prevention limits, including safeguards that may apply even when a feature is described as generous or subject to fair use.
AI-generated or AI-assisted results may include:
- reminder suggestions;
- dates and deadlines;
- summaries;
- tags;
- classifications;
- search results;
- answers from Ask Kate; and
- other extracted or generated information.
AI can make mistakes.
KateMail may misunderstand an email, identify the wrong date, miss an important deadline, incorrectly classify information, omit relevant information, or provide an inaccurate or incomplete answer.
You are responsible for reviewing information that matters to you and checking it against the original email, attachment or another authoritative source when appropriate.
You should not rely solely on KateMail for matters where an error or omission could have significant consequences, including:
- appointments and deadlines;
- bills or payment due dates;
- legal obligations;
- tax matters;
- medical or health information;
- financial decisions;
- travel requirements;
- professional or regulatory requirements; or
- other important obligations.
KateMail is an organisational assistant, not a professional adviser or authoritative source.
5. Ask Kate
Ask Kate allows you to ask questions about information available through your KateMail account.
Responses may be generated using artificial intelligence based on your stored information and other context available to the Service.
Ask Kate may misunderstand your question, fail to retrieve relevant information, or generate information that is incorrect or not contained in the original source.
When accuracy matters, check the original email, attachment or authoritative source.
6. Email delivery and processing
Sending or forwarding an email to KateMail does not guarantee that it will successfully arrive, be stored or be processed correctly.
Delivery or processing can be affected by factors such as:
- your email provider;
- forwarding configuration;
- spam or security filtering;
- sender restrictions;
- unsupported message or attachment formats;
- internet or infrastructure failures;
- service outages;
- usage limits; and
- security or abuse-prevention measures.
We may reject, quarantine or decline to process an email where reasonably necessary for security, abuse prevention, technical operation or compliance with these Terms or applicable law.
Do not use KateMail as your only copy or backup of important emails or documents.
Keep original or important information in an appropriate source or backup system.
7. Reminders and suggestions
KateMail may identify information that appears to require action and provide suggested reminders or other actions.
Suggestions are provided for convenience.
We do not guarantee that KateMail will:
- detect every reminder or deadline;
- interpret every date or time correctly;
- identify every action required by an email;
- deliver every notification at a particular time; or
- correctly determine the importance of information.
You remain responsible for managing your own deadlines, appointments and obligations.
8. Plans and usage limits
KateMail may offer free and paid plans with different features and usage limits.
Limits may apply to things such as:
- emails processed;
- Ask Kate usage;
- storage;
- attachment processing;
- AI features; or
- other functionality.
Current plan features, prices and limits are shown on our website or within your account.
If you reach a usage limit, some features or processing may be restricted or paused until your allowance resets or your plan changes.
Where possible, KateMail may retain information about an incoming email even when full AI processing cannot be performed because you have reached a usage limit. However, you should not assume that an email received after reaching a limit has been fully processed.
We may also apply reasonable safeguards against excessive, automated, fraudulent or abusive use, including to features described as unlimited or subject to fair use.
Inactive Free account policy
Free accounts that have been inactive for 12 months may have their stored content deleted after advance notice.
9. Paid subscriptions
Some KateMail features require a paid subscription.
If you purchase a subscription, the price, billing interval and applicable plan will be shown to you before you complete your purchase.
Unless otherwise stated, subscriptions automatically renew at the end of each billing period until cancelled.
Depending on the subscription you choose, billing may occur monthly, annually or at another interval shown at checkout.
Payments may be handled by a third-party payment processor.
Taxes may be included or added where required by applicable law.
10. Promotional and Founding Member pricing
KateMail may occasionally offer introductory, promotional or Founding Member pricing.
The applicable price and conditions will be shown when the offer is made.
Where a Founding Member offer expressly states that a promotional price will continue while the subscription remains continuously active, we will honour that pricing in accordance with the conditions of that offer.
If the subscription is cancelled, expires or otherwise ends, eligibility for the promotional price may also end. A later subscription may therefore be charged at the price available at that time.
Promotional pricing is generally tied to the account that received the offer and is not transferable.
11. Cancellation
You may cancel a paid subscription at any time using the billing controls provided through KateMail or our payment provider.
Unless otherwise stated, cancellation takes effect at the end of your current paid billing period.
You can continue using the paid features included in your subscription until that period ends.
Afterwards, your account may revert to the Free plan and its applicable limits.
Cancelling a subscription does not automatically delete your KateMail account or User Content.
12. Refunds and consumer rights
Except where required by applicable law or expressly stated otherwise, subscription fees are generally non-refundable for periods already purchased, including where you simply change your mind or do not use the Service.
However, you may have statutory rights to a refund, cancellation, repair, replacement or another remedy depending on where you live.
Nothing in these Terms excludes, restricts or modifies any consumer right, guarantee or remedy that cannot lawfully be excluded, restricted or modified.

13. Changes to plans and pricing
We may change KateMail's plans, features, limits or pricing from time to time.
Changes will not retrospectively alter a subscription period you have already paid for.
Where a change materially affects an existing recurring paid subscription, we will provide reasonable advance notice where required by law or reasonably practicable.
A new subscription price will normally apply from a future renewal.
If you do not wish to continue after a change, you may cancel before your next renewal.
Any specific Founding Member pricing commitment remains subject to the terms under which that offer was originally provided.
14. Changes to KateMail
KateMail is an evolving product, and its features will change over time.
We may add, modify, replace or remove features.
We will try to avoid materially reducing the core functionality of a paid subscription during a period you have already paid for unless reasonably necessary for security, legal, technical or operational reasons.
We may make changes without advance notice where reasonably necessary to:
- address a security vulnerability;
- prevent fraud or abuse;
- comply with legal requirements;
- respond to changes in third-party services; or
- protect KateMail or its users.
We do not guarantee that every feature will remain available indefinitely.
15. Service availability
We aim to keep KateMail available and reliable, but we cannot guarantee uninterrupted or error-free operation.
The Service may occasionally be unavailable because of maintenance, software errors, infrastructure failures, third-party providers, internet problems, security incidents or circumstances outside our reasonable control.
Where reasonably practicable, we will work to restore affected services.
16. Third-party services
KateMail relies on third-party services to provide parts of the Service.
These may include providers of:
- cloud infrastructure;
- email routing and delivery;
- artificial intelligence;
- authentication;
- payment processing;
- analytics; and
- other technical services.
Changes, interruptions or failures affecting those services may affect KateMail.
Our use of service providers and handling of personal information are described further in our Privacy Policy.
17. Privacy
Your privacy is important to us.
Our Privacy Policy explains how KateMail collects, uses, stores, processes and discloses personal information.
Because emails and attachments may contain personal information relating to you or other people, we encourage you to review the Privacy Policy before using KateMail.

18. Security
We use reasonable technical and organisational measures designed to protect KateMail and the information processed through the Service.
However, no internet-based service can guarantee absolute security.
You are responsible for protecting your KateMail account and the email accounts you connect to or use with the Service.
You must not attempt to:
- gain unauthorised access to KateMail or another person's account;
- circumvent authentication, security or usage controls;
- probe or test vulnerabilities without permission;
- interfere with normal operation of the Service;
- introduce malware or harmful code;
- scrape or automate access in a way that materially disrupts the Service; or
- use KateMail in a way that creates an unreasonable security risk.
19. Intellectual property
You retain ownership of your User Content.
KateMail and its software, designs, branding, interfaces and other materials provided as part of the Service are owned by us or our licensors and are protected by applicable intellectual property laws.
Subject to these Terms, we give you a limited, non-exclusive, non-transferable right to access and use KateMail for its intended purpose.
You may not copy, sell, redistribute or commercially exploit KateMail itself except where we expressly permit it or applicable law gives you that right.
20. Feedback
We welcome feedback and suggestions.
If you choose to provide ideas, suggestions or feedback about KateMail, you allow us to use them to develop and improve the Service without an obligation to compensate you.
This does not give us ownership of your User Content.
21. Suspension and termination
You may stop using KateMail and close your account at any time.
We may suspend, restrict or terminate an account where we reasonably believe this is necessary because of:
- a serious or repeated breach of these Terms;
- non-payment;
- fraudulent or abusive activity;
- a security threat;
- unlawful activity;
- a legal requirement; or
- conduct creating a material risk to KateMail, its users or third parties.
Where appropriate and reasonably practicable, we will provide notice and an opportunity to resolve the issue before permanently terminating an account.
Immediate action may be necessary in cases involving security, fraud, abuse or legal obligations.
Following account closure or termination, User Content will be handled in accordance with our Privacy Policy and applicable law.
22. Responsibility and liability
KateMail is designed as an organisational and productivity tool.
You remain responsible for decisions and actions you take based on information obtained through the Service.
To the maximum extent permitted by applicable law, KateMail will not be liable for indirect, incidental, special or consequential loss arising from circumstances such as:
- reliance on an inaccurate or incomplete AI-generated result;
- a missed or incorrectly identified reminder or deadline;
- failure of an email to arrive or be processed;
- reliance on KateMail as the sole copy of important information;
- temporary interruption of the Service; or
- circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes, restricts or modifies consumer protections or other rights that cannot legally be excluded, restricted or modified.
23. Your responsibility when using KateMail
You are responsible for ensuring that your use of KateMail complies with applicable laws and these Terms.
If you configure automatic email forwarding, you are responsible for considering what information will be forwarded to KateMail and whether you are permitted to process that information through the Service.
You should review important source material instead of relying solely on automatically generated information.
24. Changes to these Terms
We may update these Terms from time to time to reflect changes to KateMail, applicable law, security requirements or our business practices.
The latest version will be published on this page with its effective date.
If we make a material change, we will take reasonable steps to notify affected users in advance where appropriate.
If a material change applies to a future renewal of your paid subscription and you do not wish to accept it, you may cancel the subscription before that renewal, subject to any rights you have under applicable law.
25. Governing law
These Terms are governed by the laws of Western Australia, Australia.
If you are a consumer, you may have additional rights under the mandatory laws of the country or region where you live.
Nothing in these Terms affects any right or remedy that cannot lawfully be excluded, restricted or modified by agreement.
Any dispute relating to these Terms or the Service will be subject to the jurisdiction of the courts of Western Australia, except where applicable law gives you the right to bring proceedings in another jurisdiction.
26. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
If we do not enforce a provision immediately, that does not mean we have waived our right to enforce it later.
These Terms, together with our Privacy Policy and any additional terms expressly presented to you for a particular feature or service, form the agreement governing your use of KateMail.
